Agreement to These Terms
These Terms and Conditions govern access to and use of LeaseCue, a rental lead command center operated by Peirce Labs. By accessing or using LeaseCue, creating an account, or connecting an integration, you agree to these Terms.
If you use LeaseCue on behalf of a company, brokerage, property management business, or leasing team, you represent that you have authority to bind that organization to these Terms. If you do not agree, do not use LeaseCue.
The Service
LeaseCue helps leasing professionals capture rental inquiries, organize lead history, manage property settings, send questionnaires, draft or send follow-ups, coordinate calls and messages, and book showings. Some features may be automated, AI-assisted, experimental, or dependent on third-party integrations.
LeaseCue is a workflow and productivity tool. It is not a law firm, credit reporting agency, tenant screening bureau, broker of record, property manager, payment processor, telecommunications carrier, or housing authority.
Accounts and Access
You are responsible for maintaining accurate account information, protecting your login credentials, controlling team access, and promptly notifying us of unauthorized use. You are responsible for activity that occurs under your account.
We may suspend or restrict access if we believe an account is being used unlawfully, insecurely, abusively, or in violation of these Terms.
Your Content and Data
"Customer Content" means information you or your integrations submit to LeaseCue, including lead records, prospect information, property details, screening rules, questionnaire content, communications, calendar information, notes, and workflow history.
You retain ownership of your Customer Content. You grant Peirce Labs a limited right to host, process, transmit, display, and use Customer Content as needed to provide, maintain, secure, and improve LeaseCue.
You represent that you have all rights, permissions, notices, and consents needed to submit Customer Content to LeaseCue and to use LeaseCue for your leasing workflows.
Compliance Responsibilities
You are responsible for using LeaseCue in compliance with all laws, rules, industry obligations, platform terms, and professional duties that apply to your business. This may include housing, leasing, privacy, communications, consumer protection, recordkeeping, advertising, consent, call recording, email, SMS, telemarketing, and fair housing requirements.
You may not use LeaseCue to discriminate against prospects or tenants, create discriminatory rules or messages, avoid required notices, make unlawful housing decisions, or otherwise violate fair housing or equal opportunity laws.
You are responsible for reviewing questionnaires, screening criteria, messages, automation settings, AI-assisted outputs, and final leasing decisions before acting on them.
AI-Assisted Outputs and Automations
LeaseCue may provide next-action cues, drafts, summaries, scores, classifications, voice or call flows, or other AI-assisted outputs. These outputs may be incomplete, inaccurate, delayed, or unsuitable for a particular situation.
You are responsible for reviewing and approving outputs before relying on them, communicating them to prospects, or using them in leasing workflows. LeaseCue does not guarantee lead quality, tenant eligibility, showing attendance, rental outcomes, legal compliance, or business results.
Communications and Consent
LeaseCue may help send or manage emails, SMS messages, phone calls, calendar invites, questionnaires, and follow-ups. You are responsible for ensuring that recipients have provided any required consent and that your communications comply with applicable laws, platform rules, opt-out requirements, and call recording obligations.
You may not use LeaseCue to send spam, deceptive messages, unlawful solicitations, abusive communications, or messages that violate third-party provider rules.
Integrations and Third-Party Services
LeaseCue may connect to third-party services such as Google, payment processors, communications providers, listing sources, analytics providers, and hosting platforms. Your use of those services may be governed by separate terms and privacy policies.
We are not responsible for third-party services, their availability, their changes, or their handling of data except as expressly required by our agreements with you.
Billing and Subscriptions
Paid plans, if offered, may be billed on a subscription or usage basis. Pricing, usage limits, renewal terms, taxes, and cancellation terms may be shown in the app, in an order form, or in a separate written agreement.
Unless a separate agreement states otherwise, fees are non-refundable except where required by law or expressly stated by Peirce Labs.
Acceptable Use
You agree not to:
- Use LeaseCue for unlawful, discriminatory, deceptive, harmful, or abusive purposes.
- Upload malware, attempt unauthorized access, interfere with service security, or overload the service.
- Reverse engineer, scrape, resell, or copy LeaseCue except as allowed by law or written permission.
- Submit sensitive data that LeaseCue does not request or support, such as Social Security numbers, government IDs, health records, or payment card numbers, unless a specific feature and agreement allows it.
- Misrepresent your identity, property, availability, authority, fees, screening criteria, or relationship with a prospect.
Intellectual Property
LeaseCue, including its software, design, branding, workflows, documentation, and other materials, is owned by Peirce Labs or its licensors. These Terms do not transfer any ownership rights to you.
Feedback or suggestions you provide may be used by Peirce Labs without restriction or obligation to you.
Privacy
Our Privacy Policy explains how we collect, use, and share information. By using LeaseCue, you also agree to the practices described in the Privacy Policy.
Service Changes and Availability
We may modify, suspend, or discontinue parts of LeaseCue at any time. We work to keep the service available, but we do not guarantee uninterrupted, error-free, or fully secure operation.
Disclaimers
LeaseCue is provided "as is" and "as available." To the fullest extent permitted by law, Peirce Labs disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Limitation of Liability
To the fullest extent permitted by law, Peirce Labs will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost goodwill, housing outcomes, or business interruption, arising from or related to LeaseCue.
To the fullest extent permitted by law, Peirce Labs' total liability for claims related to LeaseCue will not exceed the amounts paid by you to Peirce Labs for the service in the three months before the event giving rise to the claim, or one hundred dollars ($100), whichever is greater.
Indemnification
You agree to defend, indemnify, and hold harmless Peirce Labs from claims, damages, liabilities, losses, and expenses arising from your Customer Content, your use of LeaseCue, your communications with prospects, your leasing decisions, your violation of these Terms, or your violation of applicable law or third-party rights.
Termination
You may stop using LeaseCue at any time. We may suspend or terminate access if you violate these Terms, create risk for the service or other users, fail to pay fees, or use LeaseCue unlawfully. After termination, certain provisions will survive, including ownership, payment obligations, disclaimers, limitations of liability, indemnity, and dispute provisions.
Governing Terms
These Terms are governed by the laws of the United States and the state identified in your applicable order form or written agreement with Peirce Labs. If no separate agreement applies, governing law and venue will be determined by applicable law and the location of the Peirce Labs entity providing the service.
Changes to These Terms
We may update these Terms from time to time. The updated version will be indicated by a revised "Last updated" date. Continued use of LeaseCue after updates become effective means you accept the updated Terms.
